eBay Clarifies Position on "Aggregator" Sites

Antiquecast.com Receives eBay’s Go Ahead For Real Time Search

In the midst of controversy, litigation and a preliminary DOJ, anti trust investigation involving eBay and a number of so called "aggregator" sites including Bidder's Edge and Auction Watch, eBay’s intellectual property attorney, Jay Monahan, contacted Antiquecast.com. regarding the technical nature of their aggregate search and informed them of eBay's position on search technologies. "As long as the search is realtime, they have no objection to it at this time." says Jon Majerik, CEO of Antiquecast.com Unlike Antiquecast's search the Bidder's Edge search utilized robots. Robots are generally automated crawling mechanisms that exist to load, read and index as many pages from a given site as possible in the shortest amount of time. They are requesting thousands of pages and this places a tremendous burden on the server they are accessing. It is also a problem for auction sites because the moment the robot "leaves" the data it has retrieved is outdated. Ebay’s acceptance of Antiquecast's search technology is significant because it puts to rest some fears expressed in scholarly quarters that Judge Ronald Whyte’s resent injunction against the Bidder's Edge search of eBay could have a far reaching negitive impact on the web. Experts, including Stanford's Lawrence Lessig and Harvard Law's Jonathan Zittrain, filed a brief earlier this year on behalf of Bidder's Edge warning that the injunction "sweeps so broadly as to endanger many of the most fundamental activities on which the Internet and electronic commerce are based." Some experts fear that even conventional search engines that "crawl" web sites and display "deep content" without the express permission of the web sites owners could be effected. Antiquecast is an antiques and collectibles portal that searches and aggregates multiple auction listings and sales results, including those of eBay and Sothebys.com in real time. Their search functions much in the same way as does a browser like Netscape. The search activities of the robotic sites effected by Judge Whyte's ruling may eventually be proven to constitute what is known in legal circles as a "trespass to chattels" and may be shown to damage eBay’s server through excessive automated search query. Majerik says, "We are delighted that eBay has clarified its position on the acceptability of our real time search of its auction listings. We feel their action goes a long way to dispel any concerns the DOJ may have regarding anticompetitive practices on the part of eBay.
